A man imprisoned for writing fantasies in his journal about torturing and molesting children has appealed a judge's ruling that upheld his guilty plea.
American Civil Liberties Union attorneys representing Brian Dalton, 22, want an Ohio appeals court to allow Dalton to withdraw his guilty plea on a charge of pandering obscenity involving a minor.
Last month, a Franklin County Common Pleas judge upheld a September ruling that Dalton could not change his plea.
The ACLU had asked the judge to reconsider, arguing that Dalton received bad legal advice from his attorney during the July 3 plea.
Dalton was charged after his mother discovered his journal and gave it to authorities. He was sentenced to 10 years in prison, which included three years for violating probation from a 1998 pandering conviction involving pornographic photographs of children.
The case has alarmed First Amendment experts, who believe Dalton is the first person in the United States successfully prosecuted for child pornography that involved writings, not images.

Of course growing up in Ohio I also knew that it was a circle of hell...but right now I'm missing it. Flying home tomorrow.....
